Let's recap all that has happened over approximately 4 years since TESA was formed as a Community group for responsible development:
- Two proposals for an RV Park on a hillside site in Torch River Bridge were DENIED by the Planning Commission.
- The RV Park Ordinance was REVISED to downside potential density, add green belts, protect against environmental runoff and more. The Ordinance means that an RV Park on that site is unlikely to be feasible and the site is more suited to alternative, lower impact uses.
- A POTENTIAL SALE for a 14-unit residential subdivision FELL THROUGH after the Buyer discovered all of the prescribed remediation still required if the site is developed.
- The Property was LISTED for $1.5 million and FAILED TO SELl. It is currently OFF THE MARKET.
- Sun Life Marinas, a national operator, has purchased the adjacent marina (reportedly for $10 million) from the three partners JJ&J, one of whom is also the owner of the cleared, off-market site.
TESA CONTINUES TO WATCH FOR ACTIVITY ON THE PROPERTY. WE SUPPORT RESPONSIBLE, LOW IMPACT DEVELOPMENT AND WILL FIGHT AGAINST INAPPROPRIATE PROPOSALS THAT NEGATIVELY IMPACT THE COMMUNITY OR THE ENVIRONMENT.

We are a community-based, ad hoc, action committee initially focused on stopping the development of an RV Park at the Torch River Bridge after the Developer clear cut and bulldozed the site without obtaining permits, causing significant environmental harm.
We support responsible growth that does not harm Torch, Elk, or Skegemog Lakes or their watersheds or create problems with infrastructure and pollution.
We act thoughtfully, working with recognized experts, local and state governments, media outlets, and the judicial system to achieve our goals.
We are run by volunteers and financed by donations from concerned citizens.
YOU AND TESA TOGETHER SPOKE OUT LOUD AND CLEAR!
Hundreds of citizens wrote letters and voiced their opposition (both in-person and via Zoom) and TESA experts presented evidence that the twice proposed RV Park did not meet Township ordinances for reasons including:
TRAFFIC and PARKING CONGESTION
LIFE SAFETY CONCERNS
ENVIRONMENTAL VIOLATIONS
SITE STABILIZATION PROBLEMS
DESTRUCTION OF NATURAL TOPOGRAPHY
NOISE AND LIGHT POLLUTION
and
PROJECT IS NOT CONSISTENT WITH TOWNSHIP MASTER PLAN.
THE SITE WAS THEN UNDER CONTRACT TO AN UNRELATED DEVELOPER, WHO RECEIVED APPROVAL FOR A 14 LOT SUBDIVISION. HOWEVER, THAT TRANSACTION FELL THROUGH, THE PROPERTY WAS LISTED FOR $1.5 MILLION BUT FAILED TO SELL; PROPERTY IS CURRENTLY OFF THE MARKET.
BACKGROUND:
The down-state developer of the
proposed RV Park clear-cut and bulldozed the site without a proper development permit, destabilizing the site so badly that adjoining property was damaged.
As a result, TESA filed a lawsuit citing violation of Michigan environmental law.
SETTLEMENT REACHED!
TESA, the developer and the Antrim Conservation District reached an agreement for a "whole site stabilization plan" with regular monitoring and reporting.
ALTHOUGH THE SITE HAS BEEN STABILIZED, ADDITIONAL REMEDIATION WILL BE REQUIRED IF/WHEN THE SITE IS ULTIMATELY DEVELOPED BY A RESPONSIBLE OWNER. THE ACD IS RESPONSIBLE FOR MONITORING ONGOING STABILIZATION.
TESA CONTINUES LEGAL AND ENVIRONMENTAL REVIEW OF THE SITUATION.
FIRST APPEAL DENIED
After the proposed RV Park was denied by the Milton Township Planning Commission for the first time in July, 2021, the developer filed an appeall of that decision. On April 18, 2022, the Court UPHELD the Planning Commission denial, noting the validity of all of the rationale of the denial.
SECOND APPEAL WITHDRAWN
The RV Park proposal was denied for the second time by the Milton Township Planning Commission in January of 2022. Initially an appeal of the decision was filed, but it was withdrawn.
THE DECISIONS OF THE PLANNING COMMISSION STAND.
On numerous occasions, the clear-cut site has dumped damaging sediment onto adjoining property owners, and a recent storm leached sediment into the adjacent wetlands of the Torch River. The Department of Environment, Great Lakes, and Energy (EGLE) has issued a wetlands violation to the developer for this environmental pollution. The photo above shows the river where the pollution occurred. TESA is tracking all environmental violations from the site.
